After the grant of a Patent, the Patentee is required to commercially work the Invention in India to meet the public demands. Our Law stipulates that grant of a Patent is not only for the monopoly right but also to ensure that their technology is also available to the public in due course of time. A Patentee is required to submit Statement Regarding the Working of the Patented Invention (Form -27) informing the Patent office the extent of commercial working that has taken place in India. The statement is filed for the current year ending on 31 December. The time line for filing statement of working is three months i.e. 1 January to 31 March every year. For any incorrect information in working statement or failure to file Form-27 knowingly, may result in a fine up to INR 1 million.
